1. General
The General Terms and Conditions (GTC) apply to all services and products, whether chargeable or free of charge, provided by cable car Oeschinensee (GKO AG). GKO AG is entitled to use the services of third parties in order to provide optimal performance. This is done with the automatic consent of the customer. For tickets and services provided by third parties for which GKO AG acts as a seller or intermediary, the GTC of the respective company and its products apply – e.g., combined offers with partner companies, rental of sports equipment (sleds), etc.
The contract with GKO AG is concluded upon ordering or purchasing a ticket or service or upon using such a ticket or service. These General Terms and Conditions are deemed to be accepted without reservation upon each order/purchase/use.
At the request of the cashier/train/inspection staff, the customer must identify themselves with an officially valid ID (ID card, passport, ticket). Barcode cards, KeyCards, SwissPass, local ID cards, and Half-Fare/GA cards must also be presented.
The KeyCard and similar data carriers such as the Swisspass enable contactless access to all GKO AG railways and lifts. It can be programmed with new validity data at any time and can therefore be used for several years. The KeyCard is available at all sales outlets for a deposit. The deposit will be refunded when the KeyCard is returned. Visibly defective KeyCards will not be replaced free of charge, nor will the deposit be refunded. Barcode and disposable KeyCards are deposit-free day/single-trip tickets and are used for pedestrians, tour operators, and groups. Children under the age of 6 (as of their birthday) ski for free when accompanied by an adult. A KeyCard is mandatory, except for admission to the Kinderland. The published tariff applies here.
The details regarding data protection are regulated in the GKO AG's General Terms and Conditions. Customer data is used solely for the purpose of maximizing operational security or in the interests of sales promotion, product design, crime prevention, abuse prosecution, the collection of key economic data and statistics, and invoicing. The customer acknowledges and agrees that, in cases of joint provision of services in cooperation with third parties, GKO AG is entitled to make customer data available to the third party concerned to the extent necessary in the interests of providing the services. The disclosure of customer data is permitted within the framework of the statutory provisions.
The services provided by GKO AG are set out in the service description in the mountain railway brochure or electronic media, as well as in other written offers. Special rates, special requests, or ancillary agreements are only part of the contract if they have been confirmed in writing.
Ticket prices are published at the GKO AG valley station and on the Internet. Unless otherwise stated, mountain railway ticket prices are per person and include VAT. All multi-day tickets are linear and cannot be selected individually. This does not apply to point cards. These must be redeemed by the end of the current season. Unused days expire and will not be refunded or transferred to the next season. In the event of differing fare information in the individual brochures and electronic media, the provisions according to the current publication on the Internet atoeschinensee apply. In addition to the ticket prices, GKO AG charges a KeyCard deposit of CHF 5.00. It can be used repeatedly, with several offers at the same time and, in some cases, with other companies within the industry. The deposit will be refunded upon return of the card.
Payment is due immediately upon conclusion of the contract. Ticket purchases on credit or invoice are generally not permitted. Business customers, groups, and tour operators have the option of purchasing tickets in advance via the online shop. Any exceptions must be agreed in advance and are only valid if confirmed in writing by GKO AG. When paying by invoice, the customer undertakes to pay the invoiced amount within 30 days. Objections to the invoice must be made in writing and justified within 7 days. If the customer does not meet their payment obligation within the payment period, they shall be in default without further reminder upon expiry of this period and shall pay default interest of 5%. If payment is still not made after a further reminder, GKO AG reserves all rights, including the right to discontinue all services to the customer without further notice.
GKO AG reserves the right to demand full or partial advance payment for services. This does not apply to agreements between the customer and GKO AG that stipulate otherwise. Bank transfer and check fees are to be paid by the sender.
Prices are always quoted in Swiss francs (CHF). Conversion to euros is carried out in accordance with the guidelines of Skiregion Adelboden-Lenk AG. Change is always paid out in Swiss francs.
GKO AG expressly reserves the right to change service descriptions and prices on the Internet, in brochures, and in price lists until the contract is concluded.
All tickets and passes are personal and non-transferable. Exceptions are specified in writing in special "sponsorship agreements." Season tickets and annual passes must be presented for inspection.

Children under 6 years of age are free of charge. This does not include admission to the toboggan run or other ancillary activities. In this case, the relevant tariff applies. Reduced rates for children under 16 years of age. Adult rates apply in winter and summer from the age of 16.
A group is defined as a group of at least 10 tickets purchased and paid for at the same time. Groups include associations, clubs, companies, or officially recognized schools. The group leader must purchase and pay for all tickets together. GKO AG cannot issue group tickets individually. The tickets must have the same area of validity and the same period of validity. Detailed information about attractive group discounts is available at the point of sale. Free tickets for groups are already included in the group prices.
The standard fare applies to ascents and descents for persons with reduced mobility. Companions receive a free ticket provided that the person with a disability has an SBB companion card.
In the event of loss or theft of a multi-day ticket or season ticket, a direct replacement will be provided upon presentation of the purchase receipt. After appropriate clarification, a replacement will only be provided if the ticket has not already been used. A processing fee of CHF 50 may be charged for issuing the replacement ticket.
In the event of an accident or illness affecting the cardholder, the subscription must be deposited at an issuing office as soon as possible, but no later than 14 days after the accident/illness (this can also be done by a third party). If the subscription can no longer be used, the unused days will be refunded upon submission of a medical certificate issued by a practicing physician or hospital. The date of the accident is relevant for calculating the refund. There is no entitlement to a refund for: single journeys, half-day, one-day, promotional, and special tickets. The percentage of refunds for season and annual tickets is calculated as follows:
Refunds will be made in cash or in the form of a voucher. Refunds are only possible until the end of the current season. The percentage of the

Refunds are only possible until the end of the current season. No refunds will be given for personal reasons, early departure, unfavorable weather or snow conditions. A reduced cable car service especially in the early and late season) is reserved and does not entitle you to a refund.
Cashiers, railway staff, or authorized inspection personnel are authorized to check tickets at any time. Customers must identify themselves with a valid official ID (ID card, passport, ticket). Any misuse of tickets, in particular the transfer of lift tickets or alteration of the information contained therein, will result in immediate withdrawal without compensation. In addition to the fare for the unauthorized or invalid ticket, a surcharge of CHF 150.00 will be levied in accordance with Art. 16 of the Federal Transport Act of October 4, 1985. A valid ticket must also be purchased. GKO AG also reserves the right to report the matter to the police or to pursue criminal charges. The ticket holder is responsible for ensuring that their ticket is not misused by third parties.
Operational restrictions or shutdowns due to force majeure such as wind and weather conditions, strikes, or official orders, operational disruptions (e.g., foehn winds or technical defects such as power outages) do not entitle the customer to a refund or compensation.
In the event of reckless behavior, violation of these provisions, or failure to comply with the instructions of railway, cashier, or inspection personnel, in particular failure to comply with FIS rules, failure to observe signals, instructions, and barriers, as well as skiing on closed slopes or in wildlife and forest protection zones, etc., GKO AG may revoke the ticket holder's ticket. Outside official operating hours, the runs/slopes are closed and skiing on the slopes is prohibited. The last slope check is carried out after the mountain railways have closed. Anyone who endangers safety and order in the winter sports area as a result of drunkenness or drug abuse may be temporarily or permanently excluded from using the railway facilities and winter sports slopes. There will be no refund of the ticket price. Anyone who damages or contaminates the facilities and equipment of GKO AG must pay the repair and cleaning costs. In the event of intentional damage/contamination, criminal charges may be filed.
Crossing avalanche barriers is prohibited and will result in immediate ticket withdrawal and criminal charges.
For safety reasons and in accordance with applicable SKUS rules, recreational sports equipment (e.g., airboards) of any kind is not permitted on board. Sleds are the only exception. In individual cases, GKO operating personnel will decide whether any equipment or objects may be taken on board GKO facilities.
The slopes are marked on both sides.
The 10 FIS rules of conduct apply to all snow sports guests (www.fis-ski.com).
It is prohibited to ski with small children in a backpack on all slopes and facilities of GKO AG.
If a ticket purchaser suffers an accident in the winter sports area, the GKO AG rescue service can be called upon. The rescue costs will be invoiced directly by GKO AG on a time and material basis. In addition, third-party costs such as ambulance transport, taxi, air rescue, etc. may be incurred. It is the patient's responsibility to claim any reimbursement from their insurance company.
The rental of ice skates and other equipment is governed by individualized rental agreements and the provisions contained therein. The General Terms and Conditions are always an integral part of such rental agreements concluded with GKO AG. The renter is liable for damage to the rental items. In the event of theft, an official police report is essential.
Any complaints by ticket purchasers concerning the services provided by GKO AG must be addressed to GKO AG immediately. If immediate notification is not provided, the ticket purchaser shall forfeit any claims against GKO AG.
All information published on the Internet is provided without guarantee. GKO AG accepts no liability for Internet malfunctions, damage caused by third parties, imported data of any kind, in particular viruses, worms, Trojan horses, etc. The Internet pages may contain technical inaccuracies or typographical errors. GKO AG is in no way liable for any direct, indirect, special, or other consequential damages resulting from the use of GKO AG's Internet pages or any Internet pages linked to them. Any liability for lost profits, business interruption, loss of programs, or other data in information systems is also excluded.
GKO AG's liability for personal injury and property damage is limited to those cases that are mandatory under Swiss law,

GKO AG recommends that all ticket purchasers take out additional insurance cover, such as liability insurance, cancellation insurance, travel accident and travel health insurance, extra return travel costs, insurance, etc.
GKO AG reserves the right to amend these General Terms and Conditions at any time. If the customer is significantly disadvantaged by the amendment to the General Terms and Conditions, they are entitled to terminate the contract upon the amended General Terms and Conditions coming into effect. The right of termination expires when the amendment comes into effect.
Communications by email are considered to be in writing. Swiss law applies exclusively to all contracts concluded with GKO AG under these General Terms and Conditions. The exclusive place of jurisdiction for any disputes arising from such contracts is 3718 Kandersteg.
